Please read these terms and conditions carefully as they affect your legal rights in relation to the use of Noble Minder. To use this Service you must comply with the following terms and conditions. Membership to Noble Minder is purely for childminders. No other person is granted permission to become a member.
Our sole aim is to provide our members with the tools to ensure the smooth running of their business. We are in no way replacing Ofsted or the EYFS requirements. Members are wholly and totally responsible for their conduct under law, including training, treatment of the children in their care and year end accounts submitted to HM Customs & Revenue.
1. Introduction
In these terms and conditions the following words have the following meaning:
“Noble Minder” means Noble Minder Limited (company number 6776754) whose registered office is: The Green, Datchet, Berkshire. SL3 9AS.
“Content” means the content owned or licensed by Noble Minder which is on the website.
“Service” means the service provided by the Noble Minder website.
“Input” means any data entered by a member.
2.Copyright
All content within the site is written and owned by Noble Minder or held under license from third parties.
3.Fees
Noble Minder reserves the right to increase its fees at any time, subject to 14 days notice via email.
The current monthly fee is £9.95. Your first membership fee is not payable until after your free 14 day trial.
4.Support
Noble Minder is committed to supporting and helping its members make full use of the tools within the site. It agrees to provide this support at the times and means stated on the site. This is included in the membership fee and will not be charged for additionally.
We want to be clear regarding each section of the site and the ownership of responsibility involved. Noble Minder has gone to great lengths to ensure we have researched legislation when developing the Noble Minder Tools.
All information used in doing this was accurate at the time of publication.
5.Registration
It is completely and wholly the members responsibility to ensure they have the correct registration in place for the care they are providing. Members must also comply with all conditions of their registration under government law.
Noble Minder is not responsible for this at any time and we promote that childminders are registered with Ofsted.
Noble Minder in no way replaces Ofsted or the Early Years Foundation Stage.
6.Subscribing
To use Noble Minder you must comply with these terms and conditions.
7.Profile
The profiles sections are to be updated and kept as the member so wishes, all information will only ever be accessed by the member.
It is the member's responsibility to ensure their records regarding each family are kept secure.
Noble Minder recommends each member has their own data protection to cover all information held by them.
8.Policies
Noble Minder is not responsible for the policies written or how they are implemented by its members within their setting including the Required Statements.
All guidance notes were written in good faith and were accurate at the time of publication. Members should use their own professional judgement when writing and implementing their policies.
9.EYFS
Noble Minder provides childminders with the necessary tools to aid them in meeting the assessment requirements of learning and development within Early Years Foundation Stage.
We except and strongly advise all childminders to have a full copy of the EYFS Pack within their setting and to have spent time familiarising themselves with all of the requirements and guidance.
Noble Minder does not replace Ofsted or the EYFS Requirements. We have developed the EYFS tools based solely on the Statutory Framework for the Early Years Foundation Stage.
Noble Minder recommends each member has their own data protection to cover all information held by them and photos they may want to upload to the site.
10.Risk Assessments
Members are professional childminders who are required to assess the risks, both within their homes and outside. Noble Minder provides a way to record that the assessments have been carried out. Noble Minder is not responsible for any risks that may or may not have been identified by its members.
11.Inspection
Members are required by Ofsted to run their setting to meet the Early Year Foundations Stage requirements. This is a requirement by law and is expected to be implemented every day and not just for inspections. Noble Minder encourages its members to comply with the regulations at all times.
12.Record Keeping
Members are responsible under their registration to have the required records such as children’s personal details etc these are required to be kept in a lockable place.
13. Resources
All resources are provided in good faith for members. At the time of publication all resources were accurate.
Members are required to use all resources solely for their own individual business needs and are not to be resold or passed on under any circumstances.
All links to external sites are provided in good faith; Noble Minder does not guarantee the accuracy of external information.
14.Training
Members are required by law to have completed certain training requirements. Members need to obtain and continue to update the required training. Noble Minder is not responsible for their members' training at any time.
15.Bookkeeping
All members are wholly responsible for checking that their turnover and expenses have been calculated correctly.
The bookkeeping tools are to aid members in collating yearly figures that can if the member so wishes be used to complete their tax return.
At no point is Noble Minder responsible for any of the member’s figures in Turnover, Expenses or Year End. Members are held accountable by the Inland Revenue if their accounts submitted are not accurate.
16.Security
Your card details are not held by Noble Minder. We have chosen to use sage pay (formally Protx) to handle member's payment details and transactions. All card data is encrypted as soon as it is entered with the Noble Minder Site. Visit sage pay site to read about their security.
Noble Minder has gone to great lengths to ensure the security of the site. We have a dedicated server solely for the use of our member’s data.
Our network is protected by 2 Fortigate IPS units, which operate as one system. Should one fail, the other will take over its operation with no loss in service. This provides maximum reliability while filtering any malicious traffic destined for the site.
The network is also monitored at 60 second intervals from 2 separate locations in the UK and USA, should any issues be detected the system will automatically alert an engineer and they can begin working on the issue immediately. Our Network and Server is housed within Telehouse Europe, one of the most secure and best connected datacenters in the UK. With 24 x 7 manned security, perimeter patrols, CCTV and a keycard access system you can be certain your data is physically secure as well as virtually.
No member of Noble Minder staff has access to your information except the 2 database controllers. We only gain access to your registration details for the purpose of contacting you.
After 20 minutes of inactivity the site will "time out". You will have to log in again to use the site.
17.Privacy Notice
Noble Minder is registered and complies with the 1998 Data Protection Act. Our registration number is Z1814738.
The personal information our members add to this site is for the purposes of using Noble Minder as a business tool. We do not pass on our members' details to any third party within the UK or aboard. The only exception to this is a requirement by law.
Noble Minder will only ever contact you with your updates or with our news and additions to the package.
Noble Minder site holds a number of personal and business data from our members, we at no point access your business data such as bookkeeping and child profiles etc. The only member’s information we use is that added within registration and payment, feedback and any other details you send to us via support.
We hold all previous data that our members have added to the site. We also hold data for up 90 days after a membership has been cancelled to ensure it was genuine cancellation and not an error.
18.Payment
You will pay for and be able to terminate this Service in accordance with Noble Minders current payment policy.
I understand that when my Free Trial is over I will be billed and payment taken from my card each month thereafter.
To cancel your membership go to My Account. Scroll to bottom of page and click Cancel Membership.
To cancel your membership you must cancel no less than 7 days, and no more than 30 days, before your next payment is due.
20.Using the Service
This service is designed for childminders in England.
Your login and password are for your use only and they must be kept secret and not passed on to any third party.
All copyright, trademarks, database rights and other intellectual property rights are owned by Noble Minder or licensed to it by third parties.
If you experience problems using the Service contact our Support Team. Your calls may be recorded or monitored.
The Website may contain errors and may, on occasions, not be accessible by Members.
This Service is for the use of registered Childminders only and may not be accessed by companies or organisations for commercial or any other purpose.
By using the Website you warrant that you have the right, authority and capacity to enter into and be bound by these terms.
You are solely responsible for any input you place on the site.
You will only use this website to facilitate you in your individual childminding business.
Noble Minder will operate the Website with the reasonable care and skill of an online service provider.
Noble Minder reserves the right to make any changes to the Website provided that these changes have no material adverse effect on the quality of service provided to Users.
Noble Minder will endeavour, to the best of its ability, to provide a continuous service. However, from time to time, it may be necessary to carry out maintenance, upgrades and repairs.
Noble Minder shall not be liable for any loss, or damage caused in whole or part by failures, delays and interruptions to the provision of the Website services.
21.Data Protection
Noble Minder is committed to protecting (a) the privacy of users (b) the confidentiality of the information you provide while using the Website.
Noble Minder is the data controller of the data you submitted. Noble Minder is registered under the Data Protection Act 1998 and complies with the DPA in all our dealings with your personal data.
22.Law and Jurisdiction
These terms shall be governed by and construed in accordance with the laws of England.
Failure by Noble Minder to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy.
If any court of competent jurisdiction finds any of these terms invalid, this will not affect the validity of the remaining terms, which shall remain in effect.
23.General
Noble Minder reserves the right to alter or amend our terms and conditions by giving reasonable notice. By continuing to use the Service after the expiry of the notice period, you will be deemed to have accepted these terms and conditions.
